IMPORTANT: NOT FOR EMERGENCIES.
The Services are NOT intended for emergency situations. If you believe you may have a medical or mental health emergency, or if you are worried about your safety or immediate health needs, CALL 911 IMMEDIATELY or go to the nearest emergency room or urgent care clinic.
Do not use the Services for emergencies or life-threatening conditions, including:
- Chest pain, severe shortness of breath, or difficulty breathing
- Severe injuries, uncontrolled bleeding, or major trauma
- Loss of consciousness
- Suicidal or homicidal thoughts, or immediate risk of harm
- Severe allergic reactions (e.g., swelling of face/throat, trouble breathing)
- Suspected stroke or heart attack
- Any other condition requiring immediate emergency intervention
This warning appears throughout the Services. Telehealth and our platform are designed for non-emergency care only.
2. Agreement to Terms
These Terms apply to all users of the Services, including visitors, registered users, and individuals booking services for themselves or others.
We may update these Terms from time to time by posting a revised version on our website or through the Services. The updated Terms will display a new "Last Updated" date. Your continued use of the Services after updates become effective constitutes acceptance of the updated Terms.
By checking an acceptance box during registration or booking, or otherwise using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.
3. Cancellation & Refund Policy
Doctor AllWays aims to make care simple, flexible, and reliable. Refund eligibility depends on the service type and timing of cancellation.
3.1 Refund-Eligible Cancellations
- Virtual/Telehealth Appointments: Cancel at least 3 hours before the scheduled start time for a full refund.
- In-Person Appointments: Cancel at least 24 hours before the scheduled start time for a full refund.
- Other Services (including specialist services, house call visits, urgent care clinic services, labs, imaging, and undated or voucher-style bookings): Cancel within 10 days of purchase if the service has not been performed, subject to confirmation from the applicable Provider or service partner.
- Same-day booking mistake: If you booked in error, request cancellation within 1 hour of purchase and before the service starts for a full refund (if the Provider confirms the service has not been performed).
3.2 Refunds Are NOT Available For
- No-shows or missed appointments.
- Late cancellations (within 3 hours of a virtual appointment or within 24 hours of an in-person appointment).
- Services already rendered or partially completed.
- Requests for specific medications, forms, letters, or documentation when not medically appropriate as determined by the Provider.
- Surgical procedures or procedures with confirmed scheduling requirements once confirmed.
- Lab or imaging purchases that are not completed within 7 days of purchase (unless otherwise stated at checkout).
- Refund requests submitted more than 10 days after purchase for undated services, or more than 10 days after the scheduled service date for dated services.
- Chargebacks or disputes submitted without first contacting us to investigate and resolve the issue.
3.3 How to Request a Cancellation or Refund
To cancel or request a refund, please: Log into your Doctor AllWays account and navigate to "My Appointments" (if applicable), or contact our support team through the platform messaging system, or email support@doctorallways.com / Phone: 305-677-3786 (Monday–Friday, 8:00 AM–5:00 PM ET). Please include your appointment or order confirmation number and the reason for your request.
3.4 Refund Processing
If approved, refunds are typically processed to the original payment method within 10–14 business days. Your bank or card issuer may require additional time to post the credit.
3.5 Provider Cancellations
If a Provider cancels your appointment and we cannot reasonably offer a comparable alternative within a suitable timeframe, you will receive a full refund to the original payment method, typically within 5–7 business days, and we can assist you in rebooking if desired.
4. Consent to Communications
By using the Services and providing your contact information, you expressly consent to receive communications from Doctor AllWays via SMS/text messages, WhatsApp, voice calls (including automated or pre-recorded calls where permitted by law), and email.
4.1 Types of Communications
- Appointment confirmations, reminders, and changes
- Care-related follow-ups and updates
- Test-result availability notifications
- Prescription and next-step instructions
- Service notifications and platform/security updates
- Billing and payment confirmations
- Marketing and promotional messages
- Satisfaction surveys and feedback requests
4.2 Your Certification
By providing your phone number and email address, you certify that the phone number and email address belong to you (or you are authorized to use them), you consent to receive communications at those endpoints, and carrier message and data rates may apply.
4.3 Opting Out
You can opt out of promotional communications at any time by clicking "Unsubscribe" in a marketing email, replying "STOP" to promotional texts/WhatsApp, adjusting your account preferences (if available), or contacting support@doctorallways.com.
Important: Opting out of promotional communications does not stop essential transactional messages related to your appointments, purchases, account security, healthcare services, or legally required notices.
5. Services Overview
Doctor AllWays provides a digital platform that helps users locate, compare, schedule, and pay for healthcare-related services offered by independent healthcare providers and professional practices ("Providers").
5.1 Available Services
- Search for and compare Providers by specialty, location, and availability
- Schedule virtual (telehealth) and in-person appointments
- Book specialist services
- Book house call visits
- Access urgent care clinic services
- Order or arrange lab tests and diagnostic imaging
- Receive appointment reminders and care coordination support
- Make secure payments
- Access visit summaries and records where made available by Providers
- Communicate with Providers through secure messaging where available
5.2 Platform Role
Doctor AllWays operates as a platform and administrative service. We facilitate access to Providers and related services, but we do not provide medical care, make clinical decisions, or guarantee outcomes.
6. No Medical Advice by Doctor AllWays
Doctor AllWays does not practice medicine and does not provide medical advice, diagnoses, treatment, or medical services. Any medical guidance, diagnosis, treatment, prescriptions, or clinical decisions are provided solely by the independent Providers you choose.
6.1 No Provider–Patient Relationship with Doctor AllWays
Using the Services does not create a provider–patient relationship between you and Doctor AllWays. Your clinical relationship, if any, is exclusively with the Provider(s) you select.
6.2 Do Not Delay Care
Do not ignore professional medical advice or delay seeking care because of content you encounter through the Services. Always consult a qualified healthcare provider for medical concerns.
7. Provider Independence
Providers accessible through the Services are independent professionals and/or independently owned and operated professional practices. Doctor AllWays does not:
- Employ Providers (unless expressly stated otherwise in writing)
- Control, direct, or supervise medical decision-making
- Practice medicine or provide healthcare services
- Guarantee medical outcomes, diagnoses, treatments, or prescriptions
Doctor AllWays may set platform rules and may remove Providers from the platform, but does not interfere with clinical judgment.
8. Eligibility and Account Requirements
8.1 Age Requirement
You must be at least 18 years old to create an account and use the Services independently.
8.2 Minors and Parental/Guardian Use
A parent or legal guardian may use the Services on behalf of a minor where permitted by law and Provider policy.
8.3 Geographic and Licensing Limitations
Providers can only deliver services in states or jurisdictions where they are licensed and authorized.
8.4 Account Security and Accuracy
You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Report suspected unauthorized access to security@doctorallways.com.
9. Payment Policy (Self-Pay Only)
Doctor AllWays does not submit claims to, bill, or collect payment from insurance plans. All services booked through the Services are self-pay unless expressly stated otherwise at checkout. We do not accept or bill:
- Commercial/private insurance
- Medicare or Medicare Advantage
- Medicaid or state programs
- TRICARE or other military insurance
- Workers' compensation or auto insurance
You are responsible for full payment at the time of booking or purchase.
9.1 Billing Disputes
If you believe you were charged incorrectly, contact billing@doctorallways.com within 30 days of the charge with your account email, transaction details, and a description of the issue.
10. Prescription and Medication Policy
All prescription decisions are made solely by the Provider based on independent medical judgment. Doctor AllWays does not influence prescribing decisions.
10.1 No Guarantee of Prescriptions
You are paying for the Provider's medical evaluation and professional services, not for a guaranteed prescription, diagnosis, or treatment plan.
10.2 Controlled Substances
Providers may not prescribe controlled substances via telehealth except as permitted by applicable federal (including DEA) regulations and state law.
10.3 No Refunds for Declined Prescriptions
Refunds are not available if a Provider determines that a medication, test, or request is not medically appropriate.
10.4 Pharmacy Selection
You are responsible for selecting your pharmacy and ensuring it can fill prescriptions.
11. Telehealth Services
11.1 Informed Consent
By selecting telehealth/virtual services, you acknowledge and consent to receive care via electronic communications in place of an in-person visit.
11.2 Risks and Limitations
- Technical issues or interruptions
- Limitations due to lack of physical examination
- Potential need for an in-person evaluation
- Privacy/security risks despite safeguards
11.3 Provider Determination
The Provider will determine whether your condition is appropriate for telehealth.
11.4 Location Verification and Licensing
Providers can only provide telehealth services to patients located in states where the Provider holds an active license.
11.5 Recording and Two-Party Consent
Where permitted by law, visits or interactions may be recorded for documentation, quality improvement, training, and compliance purposes.
12. User Conduct and Prohibited Activities
You agree to use the Services lawfully and not to:
- Upload or share content you do not have rights to use
- Post illegal, fraudulent, misleading, defamatory, or abusive content
- Impersonate any person or entity
- Attempt to interfere with, compromise, or disrupt the Services
- Use bots, scrapers, or automated means without written permission
- Circumvent access restrictions
- Harass, threaten, or harm Providers or other users
We may remove content, suspend or terminate accounts, and cooperate with law enforcement where appropriate.
13. Privacy, Data, and HIPAA
Our collection, use, and sharing of your information is governed by our Privacy Policy and (where applicable) Notice of Privacy Practices, available on our website. Where HIPAA applies, we implement safeguards designed to protect protected health information (PHI).
13.1 Security and Electronic Communications
While we use reasonable administrative, technical, and physical safeguards, no system is perfectly secure.
13.2 Data Retention
We may retain information as required by law, contract, or legitimate business purposes. Account deletion requests may be limited by legal and contractual obligations.
14. Intellectual Property
The Services and their content are owned by Doctor AllWays or its licensors and are protected by intellectual property laws. You may not:
- Copy, modify, distribute, sell, lease, or sublicense any part of the Services
- Reverse engineer, decompile, or disassemble software
- Create derivative works
- Remove or alter proprietary notices
- Use our content for commercial purposes without written permission
"Doctor AllWays" and the Doctor AllWays logo are trademarks of Roczar Healthcare of America Inc.
15. Third-Party Links and Services
The Services may contain links to third-party websites, applications, or resources. We do not control third-party sites and are not responsible for their content, privacy practices, or terms. Your use of third-party services is at your own risk.
16. Disclaimers and Warranties
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, DOCTOR ALLWAYS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. WE DO NOT GUARANTEE APPOINTMENT AVAILABILITY, CLINICAL OUTCOMES, DIAGNOSES, TREATMENTS, OR PRESCRIPTIONS.
17. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DOCTOR ALLWAYS AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY AND ALL CLAIMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO DOCTOR ALLWAYS IN THE SIX (6) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) $100 USD.
18. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Doctor AllWays, its affiliates, and their respective officers, directors, employees, contractors, agents, licensors, and suppliers from and against any and all claims, liabilities, damages, losses, costs, and expenses arising out of or related to: (1) your use or misuse of the Services; (2) your violation of these Terms; (3) your violation of any rights of another party; (4) your content or information you provide; (5) your negligence or willful misconduct; or (6) your violation of applicable laws or regulations.
19. Dispute Resolution (Arbitration; Class Action Waiver)
19.1 Informal Resolution
Before filing any legal claim, you agree to first contact us at contact@doctorallways.com to attempt informal resolution. Your notice must include your name, contact information, a description of the dispute, and the relief sought. We will attempt to resolve within 60 days.
19.2 Binding Arbitration
PLEASE READ CAREFULLY. EXCEPT WHERE PROHIBITED BY LAW, ANY DISPUTE THAT CANNOT BE RESOLVED INFORMALLY WILL BE RESOLVED BY BINDING ARBITRATION ON AN INDIVIDUAL BASIS. ADMINISTRATOR: AMERICAN ARBITRATION ASSOCIATION (AAA). LOCATION: REMOTE OR IN YOUR COUNTY OF RESIDENCE.
19.3 Class Action Waiver
YOU AND DOCTOR ALLWAYS AGREE THAT CLAIMS MUST BE BROUGHT IN AN INDIVIDUAL CAPACITY ONLY. NO CLASS ACTIONS, CLASS ARBITRATIONS, OR REPRESENTATIVE ACTIONS ARE PERMITTED.
19.4 Exceptions
- Small claims court actions
- Actions to enforce intellectual property rights
- Requests for temporary or emergency injunctive relief
19.5 Arbitration Costs
If your claim is for $10,000 or less, Doctor AllWays will pay the AAA filing, administration, and arbitrator fees, unless the arbitrator determines your claim is frivolous.
19.6 Opt-Out Right
You may opt out of this arbitration agreement by sending written notice to contact@doctorallways.com within 30 days of first accepting these Terms.
19.7 Severability
If any portion of this arbitration section is found unenforceable, the remainder will remain in effect.
20. Termination
You may stop using the Services at any time. To request account deletion, contact support@doctorallways.com. We may suspend or terminate your access immediately for any reason, including breach of these Terms, misuse of Services, or fraudulent activity. Sections that by their nature should survive termination will survive.
21. General Provisions
21.1 Governing Law
These Terms are governed by the laws of the State of Delaware.
21.2 Severability
If any provision is found invalid, the remaining provisions continue in full force.
21.3 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Doctor AllWays.
21.4 No Waiver
Our failure to enforce any right will not constitute a waiver.
21.5 Assignment
You may not assign these Terms without our prior written consent.
21.6 Force Majeure
Doctor AllWays will not be liable for delays or failures resulting from causes outside our reasonable control.
21.7 Notices

21.8 California Users Notice
